Welcome to the HUB 366 platform. By accessing, logging into, or using the websites, CRM systems, marketing automation tools, or software-as-a-service (SaaS) portals provided by HUB 366 Marketing Agency (“we,” “us,” “our,” or “HUB 366”), you (“User” or “you”) express your explicit agreement to be bound by these Terms & Conditions (“Terms”). If you disagree with any portion of these Terms, you are strictly prohibited from accessing or utilizing our services.
SERVICE PROVISION & THIRD-PARTY INFRASTRUCTURE LIMITATIONS
HUB 366 delivers enterprise marketing automation and customer relationship management solutions through an integrated digital architecture. You explicitly understand and agree that the continuous operation, speed, and data transmission of our services are inherently dependent on external third-party cloud infrastructure networks, host servers, and telecommunication carriers. While we strive to maintain consistent system uptime, HUB 366 shall not be held liable or financially responsible for any service interruptions, data latency, loss of information, or business suspension caused by third-party server outages, force majeure events, telecom network maintenance, or upstream digital infrastructure technical errors.
USER ACCOUNT SECURITY & CREDENTIAL LIABILITY DISCLAIMER
Account Accuracy: When creating an account, you must provide accurate, current, and verifiable information.
Credential Safeguarding: You are solely responsible for maintaining the confidentiality of your login passwords, API integrations, and access pathways.
Ultimate Responsibility: Any system actions, database modifications, or communication campaigns initiated under your account credentials will be legally deemed as authorized actions performed by you. HUB 366 hereby disclaims all liability for any unauthorized account usage, identity theft, or financial deficits arising from your failure to protect your login details.
USER CONDUCT & PROHIBITED USAGE
You agree to utilize our services strictly within the boundaries of local and international laws. You are strictly prohibited from performing the following actions within our platform:
Utilizing our automation systems to transmit unsolicited communications, promotional materials, or electronic messaging scams (SPAM).
Uploading, hosting, or distributing files that contain malicious scripts, viruses, or materials that violate intellectual property rights.
Attempting to breach, reverse-engineer, decompile, or bypass the cybersecurity firewalls, coding structures, or network perimeters of our service.
Violating personal data protection regulations within the HKSAR or your respective jurisdiction.
Any violation shall empower us to immediately suspend or terminate your service privileges without prior consultation.
INTELLECTUAL PROPERTY RIGHTS
The platform interface, core configurations, specialized algorithms, system blueprints, corporate logos, and all original content created by us remain the exclusive property of HUB 366 Marketing Agency and its official licensors. These assets are defended under international copyright, trademark, and proprietary software laws. Unauthorized duplication, reproduction, distribution, or commercial exploitation of our technical systems is strictly forbidden.
LIMITATION OF LIABILITY
To the maximum extent permitted by the laws of the Hong Kong Special Administrative Region, HUB 366, including its executives and associates, shall not be held liable for any indirect, incidental, accidental, special, consequential, or punitive damages. This includes, without limitation, loss of business revenue, corporate goodwill data, database corruption, operational downtime, or technical malfunctions arising from your capacity or incapacity to navigate our platform.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless HUB 366, its directors, employees, and technological partners from and against any claims, losses, expenditures, damages, legal liabilities, and professional fees (including legal defense costs) arising out of your breach of these Terms, misuse of our platform features, or infringement of third-party operational rights.
TERMINATION PROTOCOLS
We reserve the right, at our sole discretion and without liability or advance justification, to instantly suspend or revoke your account permissions should you engage in activities that breach these Terms or exhibit prolonged account dormancy. Upon termination, your right to leverage the HUB 366 ecosystem ceases immediately, and we bear no regulatory obligation to archive or restore your historical digital records.
GOVERNING LAW & COURT JURISDICTION
The validity, construction, enforcement, and legality of these Terms shall be governed exclusively by the laws of the Hong Kong Special Administrative Region. Both parties unconditionally agree that any legal friction, unresolved dispute, or litigation arising out of or relating to these Terms or platform operations shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.

服務提供與第三方基礎設施限制
HUB 366 透過整合的數字化生態圈為企業提供營銷自動化及客戶管理解決方案。您明確理解並同意，本服務的穩定運作與數據傳輸，高度依賴於外部第三方雲端基礎設施供應商及通訊網絡運營商的網絡連線與系統正常運行時間（Uptime）。本公司將盡最大努力維持系統穩定，但對於因第三方基礎設施供應商出現的伺服器宕機、不可抗力事件、電信網絡中斷或系統升級維護而導致的任何服務暫停、延遲、數據丟失或業務中斷，HUB 366 概不承擔任何法律及賠償責任。
用戶帳戶、安全與憑證免責
帳戶建立：您在註冊帳戶時，必須提供真實、準確及完整的資料。
憑證安全：您必須妥善保管您的登入密碼、API 金鑰及訪問權限。
終端責任：任何經由您的帳戶憑證所執行的操作行為（包括但不限於發送訊息、修改數據、購買附加功能等），均視為您本人之行為。若因您未能保護好自身密碼而導致任何帳戶遭冒用、數據洩漏或經濟損失，相關責任完全由您自行承載，本公司將免除所有相關責任。
用戶行為規範與禁止事項
您承諾在使用本服務時，必須遵守所有適用的本地及國際法律法規。您嚴禁利用本服務執行以下行為：
利用我們的系統發送未經接收者同意的垃圾郵件、濫發訊息（SPAM）或實施欺詐行為。
上傳、儲存或傳播任何帶有惡意軟體、病毒或侵害他人知識產權的內容。
嘗試破解、逆向工程或干擾本公司服務的系統結構、代碼或網絡安全防線。
違反香港及您當地關於個人資料收集與保護的法規。
如有違反，本公司有權在不作事先通知的情況下，立即終止或暫停您的帳戶訪問權限。
知識產權
本服務、平台界面、專有算法、系統設計、品牌標誌（Logo）以及本公司所創作的所有原創內容、技術資產，均屬於 HUB 366 Marketing Agency 或其授權方的專屬財產，並受知識產權法及版權法保護。未經本公司明確書面授權，您不得複製、修改、散佈或倒賣我們的技術資產。
責任限制
在香港法律所允許的最大範圍內，HUB 366 概不承擔因您使用或無法使用本服務而引致的任何間接性、附帶性、特殊性、衍生性或懲罰性的損害賠償，包括但不限於利潤損失、商譽受損、數據遺失、業務中斷或電腦故障等，即使本公司曾被告知該等損害的可能性。
彌償條款
您同意，若因您違反本條款、濫用本服務、或侵害任何第三方的權利，而導致 HUB 366 及其董事、員工、代理人遭受任何索償、損失、損害、責任及訴訟費用（包括合理的律師費），您將承擔全部彌償責任，使本公司免受損害。
終止服務
我們保留在不提供任何原因或事先通知的情況下，因您違反本條款或長期不活躍，隨時終止或暫停您訪問全部或部分服務的權利。服務終止後，您帳戶的使用權將立即停止，且我們無義務保留您帳戶內的歷史數據。
管轄法律與爭議解決
本條款的有效性、詮釋及履行，均完全受 香港特別行政區法律 管轄。雙方因本條款或本服務引起的任何爭議，應首先尋求友好協商；如協商未能達成協議，則該等爭議必須提交至香港法院進行專屬性的訴訟審理。
